Union against the oppressive, unjust, and illegal 21-day duty pattern, we have achieved unprecedented success through a historic verdict by the Hon&#8217;ble CGIT Court, Nagpur, following a hearing conducted as per the directions of the Hon&#8217;ble High Court.<\/p>\n\n\n\n<p>Today, the establishment&#8217;s tyranny has been dealt a severe blow. The court has dismantled the arbitrary policies imposed on the workers by the management.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><em>Detailed Findings Recorded by the Court in its Order:<\/em><\/h3>\n\n\n\n<ol class=\"wp-block-list\">\n<li><strong>Violation of Law:<\/strong> The Hon&#8217;ble Court explicitly noted that increasing the On\/Off duty pattern from 14 days to 21 days without issuing a legal notice or a written agreement, and enforcing it without waiting for the mandatory notice period, is a serious violation of <strong>Section 9-A of the Industrial Disputes Act, 1947<\/strong>.<\/li>\n\n\n\n<li><strong>Unjust Enforcement:<\/strong> The court agreed that the management&#8217;s attempt to enforce this change starting from May 7, 2026, is against the Law.<\/li>\n\n\n\n<li><strong>Harm to Workers:<\/strong> The court confirmed that this unjust pattern is causing irreparable harm\/loss\u2014financially, mentally, and physically\u2014to the workers.<\/li>\n<\/ol>\n\n\n\n<h3 class=\"wp-block-heading\"><em>The Historic Order of the CGIT Court:<\/em><\/h3>\n\n\n\n<p>The Hon&#8217;ble Court has issued the following strict directives to the respondent (Management):<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Right to Overtime:<\/strong> For the additional 7 days that workers put in after their standard 14-day duty, the management <strong>must pay &#8216;Overtime Wages&#8217;<\/strong> for each of those days.<\/li>\n\n\n\n<li><strong>Old References Sustained:<\/strong> This overtime will be calculated in accordance with the official Office Orders dated <strong>03.01.1992 and 03.04.2014<\/strong>.<\/li>\n\n\n\n<li><strong>Permanent Relief:<\/strong> This order will remain in effect until the final verdict of the Mumbai CGIT Case No. 51\/2025 is delivered.<br>This victory was not achieved easily.
